By accessing or using Nerq ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. "Nerq" refers to the platform operated at nerq.ai, including all APIs, websites, and tools provided thereunder.
Nerq provides AI agent discovery, EU AI Act compliance assessments, risk classification, trust scoring, and related informational services. The Service includes free and, in the future, paid tiers.
The Service provides regulatory compliance assessments for informational purposes only. It does not constitute legal, regulatory, or professional advice. You are solely responsible for ensuring your AI systems comply with applicable laws and regulations. Nerq does not guarantee the accuracy, completeness, or timeliness of any assessment.
Assessments are generated using artificial intelligence and automated analysis. Results should be reviewed by qualified professionals before being relied upon for compliance decisions.
If a compliance score is below 80% or a classification confidence is below 80%, Nerq strongly recommends consulting a qualified legal professional.

Nerq retains all rights in the Service, including software, APIs, models, and content. You retain ownership of data you submit. By submitting data, you grant Nerq a limited license to process it for the purpose of providing the Service.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. Nerq disclaims all warranties, including but not limited to merchantability, fitness for a particular purpose, accuracy, and non-infringement. Nerq does not warrant that assessments will be error-free, complete, or current.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NERQ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO REGULATORY FINES, PENALTIES, LOST PROFITS, OR BUSINESS INTERRUPTION.
Nerq's total aggregate liability for any claims arising from your use of the Service shall not exceed the greater of (a) the amount you paid to Nerq in the twelve (12) months preceding the claim, or (b) one hundred euros (€100).
You agree to indemnify and hold harmless Nerq and its operators from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your reliance on any compliance assessment provided by the Service.
Compliance badges provided by Nerq reflect automated assessments at a point in time. They do not constitute certification, endorsement, or guarantee of regulatory compliance. You are responsible for ensuring badge usage does not create misleading impressions about your compliance status.
Assessments, classifications, and scores generated by Nerq use artificial intelligence, including large language models and keyword-based analysis. These outputs are probabilistic and may contain errors. Every assessment is clearly labeled as AI-generated.
Nerq may modify these Terms at any time. Continued use of the Service after modifications constitutes acceptance. For paid services, material changes will be communicated with at least 30 days' notice.
Nerq may suspend or terminate access to the Service at any time for any reason. You may stop using the Service at any time.
These Terms are governed by the laws of Sweden. Any disputes shall be resolved by the courts of Stockholm, Sweden.
